Steven Bierman, independent arbitrator and mediator and formerly a leader of Sidley Austin LLP’s New York Litigation Group for 25 years, will present on “Strategic Preparation to Optimize Mediation Outcomes: Practical Tools for Mediators, Counsel, and Parties.”

Every mediation of a dispute is unique in its way, yet the common foundation of all successful mediations is smart, intentional, effective preparation. Everyone prepares, but not everyone does so strategically in order to create the best chance for success. While distinct, the roles of mediators, counsel, and parties are interconnected, and Steve will explore practical tools to enable all mediation participants to foster a resolution mindset, to identify objectives and issues, to navigate the negotiation process, and to anticipate potential obstacles to a solution, so that everyone comes to the table ready to achieve the best outcome.

Our presenter:

STEVEN M. BIERMAN is an independent arbitrator, mediator, and dispute resolution advisor based in New York and Connecticut and founder of Bierman ADR LLC. Previously, as a partner at Sidley Austin LLP, Steve was a leader of the New York Litigation Group for 25 years and Sidley’s global Complex Commercial Litigation and Disputes practice. With extensive practical experience and having served as a mediator or arbitrator in 200+ cases, Steve brings a unique perspective to successful dispute solutions.

Steve is a Fellow of the Chartered Institute of Arbitrators (FCIArb), accredited as a mediator by the Centre for Effective Dispute Resolution, and serves on the American Arbitration Association’s National Commercial Roster of Arbitrators and Mediators, the AAA Consumer Panel, the CPR International Institute for Conflict Prevention and Resolution’s Panel of Distinguished Neutrals (arbitrator, mediator, and dispute prevention), and the Mediation Panels of the U.S. District Courts for the S.D.N.Y., E.D.N.Y., and New York state courts.

Steve is Co-Chair of the ABA Dispute Resolution Section's Mediation Committee and served as Chair of the ABA’s Advanced Mediation and Advocacy Skills Institute in 2023 and 2024. He is Co-Chair of CPR’s Mediation Committee, and serves on the Mediator Advisory Committee of the U.S. District Court for the S.D.N.Y. and the ADR Advisory Council of the U.S. District Court for the E.D.N.Y.

Steve was a 2024 recipient of the Eighth Annual James Duane Award, presented by the S.D.N.Y. Bench and Bar for exemplary service to the Court as mediator and contributions to the rule of law. As a litigator, Steve was recognized multiple times by Benchmark Litigation as a U.S. and a N.Y. Commercial Litigation Star, Best Lawyers in America, and The Legal 500 in Commercial Litigation.

Steve writes and speaks frequently on dispute resolution. He is Co-Editor-in-Chief of "The New York Dispute Resolution Lawyer," the New York State Bar Association Dispute Resolution Section’s journal, and was Editor of "The Complex Commercial Litigation Law Review" and co-author of the New York chapter (Law Business Research, 3rd ed.).
